FORECLOSURE SALE NOTICE

WHEREAS, default in the payment of principal and interest
has occurred under the terms of a promissory note (the “Note”)
dated 11/09/2011 executed and delivered by Rebecca M. Tilden
and Scott F. Wagner, by Rebecca M. Tilden as Attorney-in-Fact
for Scott. F. Wagner to Wells Fargo Bank, N.A. and a real estate
mortgage (the “Mortgage”) of the same date securing the Note,
which Mortgage was executed and delivered by Rebecca M. Tilden
and Scott F. Wagner, by Rebecca M. Tilden as Attorney-in-Fact for
Scott. F. Wagner, wife and husband; as Joint Tenants (the “Mortgagors”), to Wells Fargo Bank, N.A., and which Mortgage was recorded on 11/15/2011, as Instrument No. 2011-6609 in the records
of the office of the County Clerk and ex-officio Register of Deeds in
and for Park County, State of Wyoming; and
WHEREAS, the Mortgage contains a power of sale which by
reason of said default, the Mortgagee declares to have become
operative, and no suit or proceeding has been instituted at law to
recover the debt secured by the Mortgage, or any part there-of,
nor has any such suit or proceeding been instituted and the same
discontinued; and
WHEREAS, written notice of intent to foreclose the Mortgage
by advertisement and sale has been served upon the record owner
and the party in possession of the mortgaged premises at least ten
(10) days prior to the commencement of this publication, and the
amount due upon the Mortgage on the date of first publication of
this notice of sale being the total sum of $216,416.52 which sum
consists of the unpaid principal balance of $200,630.83 plus Interest accrued to the date of the first publication of this notice in the
amount of $9,373.84 plus attorneys’ fees, costs expended, and accruing interest and late charges after the date of first publication of
this notice of sale;
WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished
at the sale. Any prospective purchaser should research the status
of title before submitting a bid;
NOW, THEREFORE Wells Fargo Bank, N.A., as the Mortgagee, will have the Mortgage foreclosed as by law provided by causing the mortgaged property to be sold at public venue by the Sheriff
or Deputy Sheriff in and for Park County, Wyoming to the highest
bidder for cash at 10:00 AM o’clock in the forenoon on 04/22/2020
at the Park County Government building located at 1002 Sheridan
Ave, Cody, Wyoming, Park County for application on the above-described amounts secured by the Mortgage, said mortgaged property being described as follows, to-wit:
Lot 13, Ranchette Estates Subdivision, as located in Book
“C” of plats, Page 76, according to the records of the County Clerk
and Recorder of Park County, State of Wyoming. Excepting therefrom all that portion of Lot 13 lying southeasterly of the following
described line: Beginning at a point on the southwest line of Lot 13,
the point being S. 38 degrees 03’00” E. a distance of 428.04 feet
from the northwesterly corner of Lot 13; thence N. 53 degrees 40’
38” E., along the lot division line, for a distance of 402.59 feet, more
or less, to a point on the northeast line of Lot 13, the point being S.
43 degrees 59’ 56” E. a distance of 497.62 feet from the northeasterly corner of Lot 13.
Corrected by Affidavit of Scrivener’s Error, recorded with the
Clerk and Recorder’s Office in Park County, Wyoming on May 14,
2018, at Reception No. 2018-2306, to read as follows:
Lot 13, Ranchette Estates Subdivision, according to the plat
recorded in Book “C” of Plats, page 76, Park County, Wyoming,
EXCEPTING THEREFROM all that portion of Lot 13 lying southeasterly of the following described line:
Beginning at a point on the southwest line of Lot 13, the point
being S. 38°03’00” E. a distance of 428.04 feet from the northwesterly corner of Lot 13; thence N. 53°40’38” E. along the lot division
line for a distance of 402.59 feet, more or less, to a point on the
northeast line of Lot 13, the point being S. 43°59’56” E. a distance
of 497.62 feet from the northeasterly corner of Lot 13.
With an address of: 20 Ranchette Rd. Cody, WY 82414.
Together with all improvements thereon situate and all fixtures and appurtenances thereto.
