FORECLOSURE SALE NOTICE

WHEREAS, on February 26, 2015, Dennis Meyer Danzik and Elizabeth Jo Danzik, as mortgagors, executed and delivered to Richard S. Rofé, as mortgagee, a mortgage on certain real property described in the mortgage as security for payment of a promissory note in the principal amount of $750,000.00, which was executed by Dennis Meyer Danzik and Elizabeth Jo Danzik in favor of Richard S. Rofé on February 26, 2015. The mortgage was duly recorded at the office of the County Clerk in and for Park County, Wyoming on March 3, 2015, as Document No. 2015-947; and

WHEREAS, there have been material breaches of the promissory note and mortgage, and Defendants are thus in default; and

WHEREAS, the mortgage contains a right of foreclosure provision which, by reason of the above-stated defaults, Richard S. Rofé, as the owner and holder of the mortgage, declares to have become operative; and

WHEREAS, on May 1, 2017, Richard S. Rofé, as Plaintiff (“Plaintiff”), filed a Complaint against Dennis Meyer Danzik and Elizabeth Jo Danzik, as Defendants (collectively, “Defendants”), in Civil Action Number 28770 in the District Court, Fifth Judicial District in and for Park County, Wyoming, and on December 2, 2019, judgment was entered in favor of Plaintiff in the sum of $1,327,834.94, plus all additional reasonable attorney’s fees and costs incurred by Plaintiff and post-judgment interest at the rate of 10% per annum; and the Court has ordered that the mortgage be foreclosed and the property securing the same be sold; and

WHEREAS, as of April 24, 2020, the total amount due and owing to Plaintiff is $1,388,646.84. The total amount due may also increase in an amount equal to any additional attorney’s fees and costs incurred by Plaintiff and post-judgment interest at the rate of 10% per annum; and

WHEREAS, the property being foreclosed upon may be subject to other liens and encumbrances that will not be extinguished at the sale. Any prospective purchaser should research the status of title before submitting a bid.

NOW, THEREFORE, Plaintiff will have the mortgage foreclosed as provided by law by causing the mortgaged property to be sold at public venue by the Sheriff or Deputy Sheriff in and for Park County, Wyoming, to the highest bidder for cash at 10:00 a.m. on May 27, 2020, at the front door of the Park County Courthouse located at 1002 Sheridan Avenue, Cody, Park County, Wyoming, for application on the above-described amounts, said mortgaged property having an address of 1334 Sunset Blvd. South, Cody, Wyoming, and being more particularly described as follows, to-wit:

A parcel of land located within portions of, STOCK SUBDIVISION, as located in Book "E" of plats, Page 14; the BROWN ADDITION, as located in Book "C" of plats, Page 15 and BROWN'S SECOND ADDITION, as located in Book "C" of plats, Page 7, according to the records of the County Clerk and Recorder of Park County, State of Wyoming and a portion of Tract 82-D, all within Tract 82, Resurvey Township 52 North, Range 102 West, Township 53 North, Range 101 West and Township 53 North, Range 102 West, 6th P.M., Park County, Wyoming, being more particularly described as follows:
