Signs not allowed in state rights of way

Political candidates and real estate agents are reminded that their signs cannot be placed in a state right of way.

“We've seen an increase in the number of signs our maintenance crews are having to remove from the right-of-way fence or the right of way itself,” said Pat Mosbrucker, area maintenance foreman for the Wyoming Department of Transportation in Thermopolis. “Wyoming law and WYDOT policy prohibit placement of signs in those areas, so when our maintenance crews come through, they pick them up and take them to the maintenance office. The candidate or agent has two weeks to claim them, and then we dispose of them.”

Fines and even jail time can be inflicted on those who don't comply with the law.

Mosbrucker said the problem arises when the sign encroaches on the state right of way adjacent to property for sale.

“The signs can become a real problem for motorists, both by restricting line of sight and creating a potential collision hazard,” he said.

“We understand signs are placed to help businesses or candidates, but rights of way must stay clear of signs for safety reasons,” said Cody Beers, WYDOT public involvement specialist in Riverton.

Candidates or real estate agents who believe their signs may have been removed by WYDOT crews may contact the nearest WYDOT office to make arrangements for pickup.
